YES – LANDLORD/TENANT & FAIR HOUSING LAWS APPLY TO RECOVERY HOUSING
Recovery Housing is Housing. The people who are living in Recovery Housing are tenants. Recovery Housing is not exempt from Fair Housing or Landlord/Tenant Laws. It is important for anyone who is owning, operating, referring to, funding or living in Recovery Housing to know what the rights and responsibilities are around these laws. For instance, a person cannot be denied access to recovery housing based on participating in Medication Assisted Treatment. In addition, they cannot be simply required to leave for breaking a house rule, without the standard due process requirements under state and local landlord/tenant laws.
